Point of Order to division of the question

The main motion is divided into two questions and has already been adopted. then one menber find to conside by paragraph to original main motion is more better,  whether does  he make to point of order to divide of the question?

 

There is nothing in the facts presented which would warrant a Point of Order. This is used to point out a violation of the rules. The fact that the member personally believes it would be better to consider the motion by paragraph rather than dividing it does not mean that Divide the Question is out of order.

 

When the motion to Divide the Question is pending, the member could gain recognition to briefly state that he thinks it would be preferable to consider the motion by paragraph and that if the motion to Divide the Question is defeated, he will move to consider the motion by paragraph. (RONR, 11th ed., pg. 396)

Since the main motion (divided) has been adopted (per what the OP said), presumably both parts, the anxious member will have to move to reconsider the vote on one of the parts (and the other part later, when the first part is taken care of) before he can move to consider seriatim.

If it is too late to reconsider, he will have to move to amend whichever part of the original motions that he is uncomfortable with.

If a report should Consider by Paragraph, but have been divded into two parts, and was adopted. Now a majority, or two-thirds of the members believe should Consider by Paragraph. What motion should be used to charge(change) the mistake?
You know Divide of a question cannot be reconsidered.

I'm not clear as to what the actual "mistake" is.

If all of these events took place at a now over meeting, then whatever corrections to the "mistake" are called for can be fixed via the motion to Amend something previously adopted - p. 305.

If you were setting out to adopt some sort of "report", you probably shouldn't have been doing that in the first place - p. 507, line 30ff.

You know Divide of a question cannot be reconsidered.

 

Again, if the motion was divided and then adopted. the questions are no longer pending, and do not need any further consideration.

It's not entirely clear what has been adopted. The motion to Divide the Question, or the two motions themselves?

 

For the former...

 

If only a majority of the members believe they should have considered the motion by paragraph, it's too late to do that after Divide the Question has been adopted. They can consider each of the two new motions by paragraph if they wish, but there is no longer any avenue for a majority to consider the original motion in its complete form.

 

If 2/3 of the members believe that they should have considered the motion by paragraph, a motion to Suspend the Rules could be used to accomplish that goal.

 

Dr. Stackpole covered the latter scenario in Post #3. Again, if they have a 2/3 vote, I suppose a motion to Suspend the Rules could bring the original, undivided motion before the assembly, which would replace both of the other motions considered by the assembly.
