In an election of members of a board in which votes are cast for multiple positions on a board (RONR p. 441, ll. 11-24) in which more than the prescribed number receive a majority vote, and in an organization in which the term of office begins several months after the election, if in between the election and the commencement of the term of office one of those elected changes his mind and decides he is not willing to serve, is another candidate who also received a majority vote in the election (the one who received the most votes, if there were more than one) now elected, or must there be another election?

There's no provision in RONR for those who "lost" an election (i.e. who weren't elected) to automatically fill a vacancy. So, absent any vacancy-filling provision in the bylaws, you'll need to hold an election.

 

By the way, he's not "declining to serve" in the way one might immediately upon being notified that one was elected. He's resigning from an office he was elected to (but does not yet hold). So make sure the resignation is formally accepted before sending notice of the new election.

When board members are voting for 2 different candidates for the same position, is the board secretary required to identify each board member by name and who they voted for? Or can the board secretary just tally the votes and announce the results? In this case, the board secretary does not vote. The voting takes place at the beginning of a public school board meeting. Please advise.
