Guest Happy_Board_Member Posted August 28, 2015 at 07:16 PM Report Share Posted August 28, 2015 at 07:16 PM A Board Member officially resigned 4 months ago (her term would have had 20 months left) and now that the elections for new Board Members are about to begin, this ex-Board Member has nominated herself to run for the Board again. We have no policy in our By-Laws regarding this. What is the precedence for this on other Boards or in RONR? Is there anything preventing her from running again? Can we add a provision regarding this action to our By-Laws before the official Ballots go out?
Edgar Guest Posted August 28, 2015 at 07:19 PM Report Share Posted August 28, 2015 at 07:19 PM No rule in RONR prohibits this person from being nominated for and/or elected to the position from which she recently resigned. Whether your bylaws can be amended before the election depends on the amendment process described in your bylaws (and, of course, the willingness of the membership to adopt this change). Edited at 3:50 PM to add: Be careful what you wish for. The time will come when you'll want to elect someone who had recently resigned. Better to leave it to the voters and not place too many inflexible restrictions in the bylaws.
