parkourninja Posted November 10, 2015 at 01:59 PM Report Share Posted November 10, 2015 at 01:59 PM Our organization is run by 6 officers and has about 40 members (it is a student-run organization in high school but the members do not receive any votes, only officers can vote). We are considering the possibility of removing one of the current members. The bylaws specify that any vote normally requiring a 2/3 vote requires a 5/6 vote (5 of the 6 officers). Would the vote to remove a member require a 2/3 vote, therefore requiring 5 votes in our instance, or would it require a majority vote, 4 votes in this instance? Hieu H. Huynh Posted November 10, 2015 at 02:10 PM Report Share Posted November 10, 2015 at 02:10 PM Ultimately, it is up to your organization to interpret your bylaws. Generally, a two-thirds vote is required to expel a member. Note that abstentions do not count in this case (see FAQ #6).
Gödel Fan Posted November 10, 2015 at 02:11 PM Report Share Posted November 10, 2015 at 02:11 PM How did the situation come about that only officers may vote? Is that in your bylaws, or maybe a relevant school code or law? How do these officers get chosen if members don't vote on things? If all you mean is that the officers are delegated a lot of power, is discipline one of those powers, including the power to expel? A 5/6 vote, by the way, doesn't mean 5 of the 6 officers, unless your quorum is 6. With 4 officers present (a quorum if you rely on RONR to set your quorum), it would take only 4 votes to achieve 5/6.

You're getting ahead of yourself, however, as the vote on the penalty is the last step in a lengthy disciplinary procedure. See RONR, 11th ed., Ch. XX for more information.
