Breaching Board Member

All,

We have an unruly board member who is constantly trying to derail the meeting (through false allegations, speaking out of turn, etc.).   Section XX provides disciplinary procedures to be followed in this instance.  Following the wording of under Section XX pg. 647, if the offending member "is required to leave the hall during consideration of his penalty, a motion to require the member's departure during consideration of the penalty - which may be assumed by the chair if he thinks it appropriate - is unbeatable, is unnameable, and requires a majority vote. " (pg. 647 lines 21-27). 

Question- So there Chair can make this motion himself?  Can the Chair call for a motion from someone else?  If the Chair does make the motion does it require a second?

RONR goes on to state that "the vote on imposing a penalty must be taken by ballot, unless the penalty proposed is only that the offender be required to leave the hall for the remainder of the meeting.  

Question - Does the Chair rule on the offending member's punishment to leave the hall for the remainder of the meeting?  Or does the Chair call for a motion from someone else?  If the Chair does make the motion (if that is allowed) does it require a second?

The quote does not appear to be from Robert's Rules of Order Newly Revised (RONR), as the words unbeatable and unnameable appear nowhere in that work.

The rule about a ballot vote applies upon the demand of a single member, but not automatically.

When the chair assumes a motion, that replaces the actions of moving and seconding the motion, which can be directly placed before the assembly by the chair simply by stating the motion.  It is the assembly and not the chair that then decides the fate of the motion.

I'm thinking the "unbeatable" and "unnameable" are a result of auto-correct on the OP's phone and it was supposed to be "undebatable" and "unamendable" and neither word is recognized by my computer's spell check.

Maybe the unruly member really is unnameable. :)

The chair does not dictate, approve, or assume what the punishment will be. The chair should wait for a motion from the assembly, or make the motion himself if in a small board meeting.
