Guest shrubber Posted May 20, 2010 at 08:19 PM Report Share Posted May 20, 2010 at 08:19 PM After an vote by ballot ( including absentee ballots ) the officers failed and continue to fail to release the vote tallies. The officers simply state that the vote has passed. This vote required a 2/3 majority. Which part of Robert's should I point to ? Our concern is that the officers will continue to recieve absentee ballots until the majority is met before showing the ( undated )ballots and tallies. Guest shrubber Posted May 20, 2010 at 08:30 PM Report Share Posted May 20, 2010 at 08:30 PM Thank you. But are not those 'should' rules? I thought they were not obligitory to be followed.

I thought they were not obligitory to be followed.I'd say they're on the strong end of the "should" spectrum. But you could always shift the burden of proof and ask the officers why they're NOT "releasing" the vote tallies. In other words, ask them to show you the rule that says they can know the numbers but other members can't.

I thought they were not obligitory to be followed."The tellers' report is entered in full in the minutes ... (p. 404, l. 9, emphasis added)." Nothing "should" in that rule. Rob Elsman Posted May 21, 2010 at 01:35 AM Report Share Posted May 21, 2010 at 01:35 AM It should never happen that the votes of those who attend a meeting are counted together with those who voted by mailed ballot. RONR (10th ed.), p. 409, ll. 4-15.Actually, if the question is in the final form, it can be done. It terms of elections, it can be done fairly easily.
