If he refuses see Official Interpretation 2006-2. I suppose you could just use the OI but if he is warned beforehand that you have the votes necessary to remove him from the Chair he may choose to bow out gracefully sparing you all a messy fight and himself the embarrassment of having the rug pulled out from under him in public.
