Disciplinary Proceeding

judge

Recommended Posts

Our organization has adopted RONR's disciplinary process. We just concluded a disciplinary matter and found the accused party guilty. All of this was conducted in Executive Session. We must now notify the accused party and advise the results. Do we also notify the complaining party of the results and findings? (complaining party has requested information) If so, how much do we tell the complaining party? Pls provide RONR cite if available.

If the complaining party is a member of the body that was meeting he should be privy to all of the facts. Under RONR, it is the general membership that has the authority to discipline members, but your rules may vary. A member is privy to what happens in executive session even if he happens to be absent. If the complaining member is not a member of the body that met, but is still a member of the society, then it is up to the body that met to decide what to reveal. (RONR, 10th ed., pg. 92, line 23 - pg. 93, line 25)

If the complaining party is not a member of the society, then if the accused party was expelled he may be informed that the individual is no longer a member. Nothing else may be made known outside of the society. (RONR, 10th ed., pg. 630, lines 21-25; pg. 630, line 29 - pg. 631, line 4)
