Vote recording error noticed after new motion made and seconded

A motion to disapprove a request was made, seconded and then voted down by a one vote margin (6-5 against, motion to disapprove fails.) A second motion, to postpone discussion of this matter until a later date was made and seconded, but before that vote could be taken a member of the board alerted the chairman that his vote on the motion to disapprove was not recorded correctly. Had his vote been recorded correctly, the motion to disapprove would have passed, thus eliminating the possibility or the second motion to postpone.

Legal counsel attending said the vote could be changed as it was just a clerical error, but one of the board members claimed that that would be out of order because a seconded motion was on the floor. Please advise how this should have been handled. Thank you!

It is too late to raise a point of order about the accuracy of the vote after a member has been recognized to make the next motion. Your legal counsel was mistaken unless you have some other rule that superscedes RONR.

Also, we recommend against making negative motions (e.g. your motion to disapprove) as it creates an unclear result when the motion fails.

Finally, a motion to postpone discussion of a matter is out of order when the assembly (board) has decided the matter. It can, however, be introduced again at the next meeting.
