If the membership wishes to amend the bylaws in this manner - which they can do - you may wish to clarify their intent in doing so. Do they wish to keep members of the same household from holding voting board positions? What about parent/child, or brother/sister, or business partners? How would they define "married"? What about couples who are dating, couples in a common-law relationship, etc? How about room-mates? Would there be any proof of residence required, or proof of a conjugal relationship?

Can a board instill a by law to prohibit married couples from occupying voting board positions at the same time?

Probably not, unless the board has the power to change the bylaws, which is not common. But whoever has the power to change the bylaws (usually the membership) could pass pretty much any requirements for office that it pleases. This usually comes back to bite them later, but they can do it.

If there are people you don't think should hold office, it's better to simply vote for someone else.
