  1. when holding a special meeting, is it allowed to change the order of the agenda? in a recent meeting one of the members was going to be late and an item on the agenda was important enough such that the Chair wanted to wait for that missing member. We recessed for ten minutes, but would it not also been possible to skip or table the specific item to later in the agenda?
  2. Is it valid for a municipal commission to vote in public session by paper ballot? situation. Land use planning and zoning commission has a vote on a request for a zone change from R1 to R3. Instead of a hand vote which is the normal method, they decide to vote by paper ballot. The issue is very political and contentious. The commission had a very heated discussion. They had never done a paper ballot for any decision in recent history.
  3. Is there a proper procedure to call a legally posted meeting that has been motioned to adjourn and voted in the affirmative to adjourn - back into session because an action on an item was not taken during that original session. See attached meeting minutes. I was told that it is proper to make a motion to rescind the motion to adjourn. I felt this was incorrect as to make a motion, there must be a open meeting from which a motion could be properly recorded. We were officially out-of-session. We proceeded back into session by a motion to rescind, took the missed action, then adjourned again.
