  1. Can someone tell me anywhere in RONR 12th edition, where a member of a nomination committee is prohibited from making a nomination from the floor?

  3. Our constitution just says nominations are taken from the floor on the first Tuesday in November. There is nothing prohibiting a member to motion for the floor to be reopened on the election night. That is why I was referring to 31:6 since our constitution is silent on reopening the floor. I posted our rule above in an earlier post.
  4. Ok. Now if before someone motions the floor to be reopened, the chair by rule of 46:18 reopens the floor, is he required to do so by that rule?
  5. If at an election some one makes a motion to reopen the floor for nominations it receives a 2nd, ronr 31:6 , it’s voted on and fails,does the chairman by rule ronr 46:18 have the authority to reopen the floor, or does the will of the assembly stand?

My thinking is that because it states that nominations shall be taken from the floor in November and doesn’t state nominations can be taken at any other time then you can’t have nominations at the election in December. I believe after reading further it looks like no conflict exist and a member can make motion to reopen nominations in December if it receives a second an majority vote.
  7. At a regular meeting in November the Captain shall appoint a Nominating Committee. The Nominating Committee shall, at the November meeting ,receive nominations from the floor for the offices of Captain, 1st Lt, and 2nd Lt. and nominations for the Board of Trustees. The nominations shall be for the election in December. The nominating committee shall prepare a ballot consisting of the nominations for the offices and board of trustees to be used at the regular meeting by eligible voting members. The Nominating committee shall conduct the election and tally votes. The results of the election shall be announced. If there is not a nomination for an office , prior to the December meeting, the Nominating committee shall investigate and nominate a member for the office. If only one member is nominated and no other nominations are received that member shall be elected by acclamation

  9. 1 ) When an organization’s constitution states that a nomination committee will take nominations from the floor on the first Tuesday in November, Would nominations from the floor be in order if taken on the election night in December or does the constitution supersede any rule in RONR 12?
  10. Excuse my inexperience but, Our rule states elections are by secret ballot, simple majority. It doesn’t say of members present, members present voting, or simple majority of entire membership. So I’m thinking it’s simple majority of members present and voting.
  11. Section 44 in RONR 12 is worded different than the section in 11. Can someone define qualification? I’m wondering is it meaning the same that if it doesn’t specify it’s always the number of members present and voting?

  15. Yes. It's has caused confusion because of the language, It's a majority of 13 present and eligible to vote, not majority of 11 who voted.
  16. The wording in my opinion needs changed but I was thinking that it was the majority of 13.

Our rules in the Bylaws on Probationary Members being voted on for regular active membership reads " The Probationary Member shall be elected to Regular Active Membership by secret ballot vote, a majority of those Regular Active Members and Life Members present and eligible to vote being necessary to elect." There were 13 members present and eligible to vote, of the 13 only 11 voted and the vote was 6 for and 5 against which based on the language above the member did not receive the majority. The way I interpret the rule is it takes a majority of 13 members to pass not a majority of 11 who voted. Thoughts on interpretation
  18. After reading the minutes they do not reflect a vote being taken but one member says there was a vote. So I don't know. It looks like someone made a motion but was told one was not needed. Nothing in minutes show the chair ask for objections.
