I have been asked the following question: "At election time for units can a person nominate themself for an office and if they do and no one runs against them but the members are not wanting that person in the position what would happen?" Our bylaws state that any member in good standing shall be eligible to hold a unit office. The bylaws further state that each unit shall elect a Commander, Senior Vice Commander, Junior Vice Commander and Treasurer.
  2. We are a Organization comprised of State Departments and Units within the State. One of our State Departments has voted to dissolve with no effective date for the dissolution. It is our standard procedure that upon dissolution the property of the organization is turned over to our National Office. The instructions state that the Treasurer is to close the bank accounts and Cashier's Checks payable to the National Organization be issued for the balance in the accounts. The National Organization must hold these funds for a period of 18 months in anticipation of reactivation of the Charter. At what point was the vote to dissolve effective and once this vote was taken, did the members have the right to disburse the funds of the organization?
  3. Our Bylaws state that elected officers serve until the adjournment of the succeeding convention or thereafter until a successor is installed. In the case of the removal of the President from office of the for cause, death, resignation or inability to discharge the duties of office, the same shall devolve upon the Vice President The question has been asked "who can ask for the Presidents resignation and how can it be handled"
