President resigns

In the 2010/11 season our President resigned, the 1st Vice President stepped in as Acting President for the remainder of the year. At our AGM in june 2012 nobody took over the position of President but we had two step in as 1st and 2nd Vice Presidents. Can our President that resigned and became the Past President for the 2010/11 season step back in and be the President without being appointed or going through an election?

The following answer assumes that your bylaws do not define an alternate procedure for filling vacant roles or for incomplete elections:

The 1st Vice President does not become the Acting President; he becomes President. There is no "Acting" to the title. Likewise, the 2nd Vice President would upgrade to the 1st Vice President, unless I'm misremembering the scattered mentions about multiple vice presidents. If you did not elect a president at your AGM in June, you have an incomplete election and should go fix it (a meeting should be called to elect a new President within your bylaws). You currently either have no President (if the bylaws say that the President's term ends at the next AGM) or the 1st Vice President from last year is your President (if the bylaws say that the President's term goes until his successor is elected).

Once someone resigns, nothing in RONR allows them to return to office except by getting re-elected.

Assuming that you meant June 2011, then you have an incomplete election. The 1st Vice President is now automaticcally the President, the 2nd Vice President is now thr 1st Vice President. It would have been easier to simply elect a President, but now you have one and you need to elect a 2nd Vice President. If the By-laws allow, the former President, or anyone "qualified" member is eligible to be elected to the 2nd Vice President position either by the Board or through another election by the general memnbership depending on what the By-laws state..

I don't believe that the succession rules for VP to Pres apply in the case of an incomplete election, but only in the case of a unexpired-term vacancy. Am I wrong?

This recent discussion would seem to support your point.

It seems we're left waiting to hear what the bylaw language says on term of office. Last year, after the president's resignation, the 1st VP ascended to President as did the 2nd to 1st VP, although it does not sound as though tdes13's group followed that process. I'd guess they think their 1st VP was both in that office and also "acting President", and the 2nd VP stayed in that office.

With this year's election, they believe they've elected (new) 1st and 2nd VPs, but no President. In fact, the "former" 1st VP may still be President, with the "or until...." language in the bylaws.
