Executive Session confidentiality

A board member got upset during a closed executive session and stormed out of the meeting. On his way through the door he announceed to the person who was the subject of discussion, and everyone else waiting for us to resume open session, we were discussing her and what we were talking about. He was loud enough we heard him inside the building.

What are our options?

He can be subject to disciplinary actions ranging from being censured to being removed from office to being expelled from the organization. See FAQ #20 for details.

Thanks Chris H. This is not the first time this behavior has occured since I was elected to the board in April '11. The yelling and tantrums happen at nearly every open session. Asking this director to behave professionally is not working. After this latest incident in executive session something has to be done to bring civility to the meetings.

If I were to move to censur him, will that require a trial or can a censured person be removed by a simple majority vote?

Neither. All it means for a member to be censured (under RONR) is that the assembly by adopting a motion goes on record stating their disapproval of something a member (or members) did or did not do. If you want to remove him from office or expel him you will need to look to FAQ #20. Also, another option is to remove him from that meeting (requires a majority vote) and see RONR pp. 626-628 for the process.

No rule in RONR requires notice for a motion of censure.

A better way to proceed is for the chairman to direct the secretary to take down the offending words and record them. Then you can begin disciplinary action using this record as evidence.

BTW, what sort of group is this? If it is a public body, you ability to discipline members might be limited by applicable statutes.
