Guest Jaycee Posted September 5, 2011 at 03:31 PM Report Share Posted September 5, 2011 at 03:31 PM How long are the ballots kept after an election for officers at the Annual General Meeting of a condo association? In the past there has been a motion to destroy the ballots immediately. Do we need a motion to destroy the ballots? Thanks, Jaycee
David A Foulkes Posted September 5, 2011 at 03:40 PM Report Share Posted September 5, 2011 at 03:40 PM "After completion of an election or balloting on a motion, if there is no possibility that the assembly may order a recount (which requires majority vote unless a special rule permits a lesser number to do so), the ballots can be ordered to be destroyed or to be filed for a certain length of time with the secretary (such as one month) before being destroyed." (RONR 10th Ed., p. 404 l. 15-20)It's up to the assembly to determine the fate of the ballots.
Rev Ed Posted September 5, 2011 at 04:45 PM Report Share Posted September 5, 2011 at 04:45 PM However, as this is a condominium, check the appropriate legislation. Some jurisdictions will dictate how long proxies used for an election are to be kept, thus it is appropriate to keep the ballots that long as well.
