Guest Mary Posted November 9, 2011 at 01:00 AM Report Share Posted November 9, 2011 at 01:00 AM What is the vote, majority or 2/3 for a body to terminate a person's membership from an organization? The appeal process that is in our organization for appealing a termination of membership and this is the final appeal. How many votes do we have to have? Gary Novosielski Posted November 9, 2011 at 01:04 AM Report Share Posted November 9, 2011 at 01:04 AM Whatever your bylaws say. Although there is an entire chapter in RONR on discipline of members, up to and including expulsion, those rules do not apply if you have customized procedures in your bylaws. You have to follow your rules. (Unless and until they are changed.)
Guest Mary Posted November 9, 2011 at 01:17 AM Report Share Posted November 9, 2011 at 01:17 AM Thanks Wonk. Our bylaws are silent to the vote. That's why I asked if it is majority or 2/3. Isn't it somewhere in RR that says a right or privilege can only be taken away by a 2/3 vote?
Gary Novosielski Posted November 9, 2011 at 02:22 AM Report Share Posted November 9, 2011 at 02:22 AM If the bylaws are actually silent on the vote, how do we know there is one? If the procedures in RONR were being followed there would ultimately be a 2/3 vote required to expel a member, but the procedures in RONR are not being followed in this situation. You need to read the exact language in your bylaws that apply to this purported vote, and see what they say. The fact that the procedures in RONR are not being followed does not make anything invalid here, as the rules in your bylaws supersede those in RONR. Josh Martin Posted November 10, 2011 at 01:49 AM Report Share Posted November 10, 2011 at 01:49 AM Isn't it somewhere in RR that says a right or privilege can only be taken away by a 2/3 vote? No. In the disciplinary procedures in RONR, a majority vote is sufficient to impose any punishment short of expulsion (which requires a 2/3 vote). But as noted, the procedures in your Bylaws supersede RONR.
