How to discharge a bill defeated in committee

Guest Paul Goldman

Recommended Posts

Assume this situation. Proposed legislation is defeated by a State Senate committee. Does the rules adopted by the body at the start of the Session have to contain the right of a member to move on the floor a motion to discharge that bill or is it something a member can do anyway?

What form would it take, and can the presiding office, in this case could a Lieutenant Governor break a tie vote on such a motion?

Okay, maybe something does. Guest Goldman has, indeed, asked his question on a -- the premier -- Robert's Rules Website Forum.

If RONR governs, then yes, a member generally would have the right to move to discharge a subordinate committee of a measure in its custody. He whould get the floor and move to discharge the committee of the measure. And the presiding officer could break a tie vote if a member -- a voting member -- of the body that is meeting.
