rbrooks Posted January 20, 2012 at 04:51 PM Report Share Posted January 20, 2012 at 04:51 PM We have three sections in our Bylaws that refer to the word Family. The first one defines as his or her spouse, and dependent unmarried children, living at home. The second defines as immediate family-wife, husband and dependent unmarried children. The third simply states "Only one person per family may serve as director or officer of the association at a time. My question is since there is clarification of FAMILY in the previous sections does the same definition apply to the last.

A thorough examination of your bylaws, in their entirety, would be required; something that's beyond the scope of this forum.

Rev Ed Posted January 20, 2012 at 06:59 PM Report Share Posted January 20, 2012 at 06:59 PM It would be up to the membership to interupt its own By-laws. But by the sounds of it, it is simply a qualifiaction for the Board so no real conflict.

Although, I suppose in the situation described by the original poster, a question of interpretation might arise, for example, if two brothers are elected as directors -- are they 'family' or not?
