Approved Nomination Slate Change

Our President Elect was promoted and is moving out of state. Her name has been approved by the membership to be on the ballot to be voted on at the next General meeting. It is not general knowledge that she is moving and cannot fulfill her term. In our bylaws, either she turns in her resignation to the Secretary and her name is withdrawn from the slate, or she remains on the slate and resigns after elections. Our bylaws stipulate the BOD-elect fills her position after elections, or the Nominations committee finds another candidate, in the 5 days left before the next General meeting....IMPOSSIBLE. Should she withdraw her name out of respect to the membership and they vote on the approved candidates only, or should we vote her in, she resigns, and the BOD fills her position by appointment and no member vote as we are allowed Has this become a matter of courtesy or should we stick to the bylaws? Either way the Nominations committee is "off the hook" to find a candidate according to our bylaws, unless she resigns before the vote.

Whether the member withdraws her name or not is up to her. Either way, the general membership would then hold an election. If she is elected and immediately declines, it's an incomplete election and the membership needs to vote again. If she does not immediately decline, but waits until later to resign, then the BoD can fill her position.

Keep in mind that unless your Bylaws state otherwise, nominations from the floor and write-in votes are allowed, so it is not a foregone conclusion that she will be elected. Also, members could write-in her name if she withdraws, so withdrawing doesn't guarantee she won't be elected.

You should always stick to the Bylaws.
