Guest Rob S Posted February 26, 2012 at 07:34 PM Report Share Posted February 26, 2012 at 07:34 PM Does the President had the power to remove the Chairman of a committee that was formed by a motion and vote of the membership?
jstackpo Posted February 26, 2012 at 07:42 PM Report Share Posted February 26, 2012 at 07:42 PM Forming, or "establishing", the committee is different from populating or putting people on the committee, AKA "appointing".The appointing person or group can remove people from the committee. Guest Rob S Posted February 26, 2012 at 08:00 PM Report Share Posted February 26, 2012 at 08:00 PM Here is the scenario. A member made a motion to create a building committee stating who he thought should be on it. The motion was seconded by another member and an all in favor vote was taken. Following that motion another member made a motion to name the chairman of the committee which was also seconded by another member followed by an all in favor vote. Now the President would like to remove the chairman that was voted into that position by the membership and appoint someone who wasn't elected to serve on the committee. jstackpo Posted February 26, 2012 at 08:09 PM Report Share Posted February 26, 2012 at 08:09 PM From what you describe, only the association, via members voting, can remove the committee members or chairman, not the president. See p. 497 (not easy reading!).Also check your bylaws, many do give the President the right to appoint and remove members, sometimes even exclusively.
