Guest Guest Posted September 25, 2012 at 02:53 PM Report Share Posted September 25, 2012 at 02:53 PM Is the President of a club allowed to seek a lawyer's advice after receiving a cease and desist letter addressed to all of the club from one of its members without getting permission from the Board. We were not sure what we could and couldnt say, so legal advice seemed appropriate. We had to do it quickly so we could continue running the club. Did we have to take a vote first or does the President have the power to proceed with this legal question without Boards approval? Is the club then responsible for paying for the lawyer? Chris Harrison Posted September 25, 2012 at 03:00 PM Report Share Posted September 25, 2012 at 03:00 PM Nothing in RONR would prevent the President (and anyone for that matter) from hiring a lawyer. Of course the fee would be on his own dime so if he wants the organization to cover the legal fees he would have to get permission from the body which is authorized to grant such permission.
