The president and treasurer terms ending July 10, 2012. The 1st election was scheduled on July 28th, me and another association member ran for the election and the board deemed the election invalid because we collected the post card mailed ballots. Since then, the board (including the president and treasurer who's terms ended) decided to have another election on October 20th. They sent out new ballots, along with proxy forms. The president and treasurer (who's terms ended in July) continue to act as board members. The president mainly, who I would like to add (we just found this out after the election) pleaded guilty to arranging to haul hazardous paint waste without a manifest as required by the Resources Conservation and Recovery Act (RCRA), continues to sign off on documents and negotiate a current lawsuit against the HOA. Note: To avoid conspiracy charges for dumping paint wastes and solvents along the highway, he cooperated with the government against his two partners in the dumping scheme. What do your bylaws say about the board's power to run the election?If your bylaws permit special meetings of the association, you and your friends can call one to straighten out the mess.
