Guest 112 Posted December 29, 2012 at 11:05 PM Report Share Posted December 29, 2012 at 11:05 PM In the following situation was the correct order followed? In November a motion was made to suspend a bylaw, which would then allow members living out of town to run for officer positions. The motion was passed unanimously and out of town members were put on the ballot. In December an election was held and the out of town members won their positions in a ballot vote. Immediately after the vote a floor member motioned to reverse the bylaws back saying out of town members can't hold officer positions The motion was voted on and passed on the floor. So the two out of town members were told they no longer could hold the officer position they had just won in the election. Are you able to reverse a bylaw suspension and vote immediately after a vote takes place and take the position away from the winners?

Telling the ineligible candidates that they didn't win was the right thing to do, but no motion was required, just a point of order and a ruling by the chair. What you now have is an "incomplete election" so you'll have to vote again (and, no, the other candidates who would have won don't automatically get the job). Gary Novosielski Posted December 30, 2012 at 06:02 AM Report Share Posted December 30, 2012 at 06:02 AM Are you able to reverse a bylaw suspension and vote immediately after a vote takes place and take the position away from the winners? No, because you can't suspend a bylaw* to begin with, so the winners were not in fact winners because they never were eligible for election. For that reason, the "order" you seem to be concerned with is of no importance at all.You still need to complete your election.__________*unless it contains a provision for its own suspension (or is clearly in the nature of a rule of order, which this clearly is not). Guest Nancy N. Posted December 30, 2012 at 07:02 AM Report Share Posted December 30, 2012 at 07:02 AM Maybe I'm slow, and/or easily distracted. The assembly elected two people (yes, yes). A moment later, the same assembly voted not to elect them. How?c.t.
