Guest JC Posted February 27, 2013 at 09:41 PM Report Share Posted February 27, 2013 at 09:41 PM Help,I have decided to file a petition in court related to a rule used by our Association Board which has not been heard yet in court, but a court date set.At an upcoming meeting, is it possible for the Board to go into Executive session or do some other step in order to exclude me from the discussion?I would appreciate help in citing a Point of Order that requires myself, as a full Board Member, to not be excluded.Any help or suggestions is appreciated.JC
Bruce Lages Posted February 27, 2013 at 09:51 PM Report Share Posted February 27, 2013 at 09:51 PM If you are a member of the board, then the board has no right to exclude you from a board meeting, whether held in executive session or not. For a citation, you can use the first paragraph on p. 3 of RONR, 11th ed.
Guest Edgar Posted February 27, 2013 at 10:12 PM Report Share Posted February 27, 2013 at 10:12 PM At an upcoming meeting, is it possible for the Board to go into Executive session or do some other step in order to exclude me from the discussion?Your rights as a member could only be restricted as a result of a formal disciplinary procedure, something that is probably beyond the board's authority and, even if not, unlikely to be accomplished on short notice.
