Chris Harrison Posted September 27, 2013 at 11:31 AM Report Share Posted September 27, 2013 at 11:31 AM As far as RONR is concerned the way the bylaws word the term of office for officers determines whether the office falls vacant when the term expires or if the officer continues on until someone is elected as soon as possible (RONR pp. 573-574). What the corporate rules say on the subject is something you will need to ask the person making the claim.
Guest Edgar Posted September 27, 2013 at 11:50 AM Report Share Posted September 27, 2013 at 11:50 AM HOA BOD members term has expired at annual meeting. Why wasn't an election held at the annual meeting at which his term expired. That's usually what annual meetings are for.

Make sure to ask the management company to show you the section of the applicable rules that set out this procedure.
