Guest Erin Seaman Posted October 17, 2013 at 05:13 PM Report Share Posted October 17, 2013 at 05:13 PM If a public meeting is being rescheduled, does there need to be a formal motion by the members, or can it just be changed on the meeting notice? (The original meeting date is more than 5 days out...)
Gary Novosielski Posted October 17, 2013 at 05:42 PM Report Share Posted October 17, 2013 at 05:42 PM That depends on who has the authority to set or change meeting dates (see your bylaws). If the bylaws are silent, then the members (by a motion) can do so. But of course if it's the next meeting you want to reschedule, it's already a little late for that, because the members would have to meet before that to move and vote on the change. Well, trying to move the meeting to an earlier date would certainly be a problem. But the assembly could certainly meet (briefly) at the scheduled time, set up an adjourned meeting for a later date, and adjourn. I'd also note that since this is apparently a public meeting, there may also be issues of applicable law to consider.
