Should the President ever have absolutely personal possession and control of the organization's checkbook? For example, the treasurer moved out of area and resigned, handing over the checkbook and treasurer's records to the president to hold until a new treasurer was elected or appointed interim. This was done but the president refuses to relinquish the books and checkbook to the new treasurer, claiming he is auditing, locating receipts and bank records. It has been 4 months.

Ever? Maybe, but certainly not when you have someone else in office who's supposed to do that job.

 

For example, the treasurer moved out of area and resigned, handing over the checkbook and treasurer's records to the president to hold until a new treasurer was elected or appointed interim. This was done but the president refuses to relinquish the books and checkbook to the new treasurer, claiming he is auditing, locating receipts and bank records. It has been 4 months. 

 

The President has no authority to conduct an audit on his own. It's not really a bad idea when changing treasurers, but the organization should appoint a committee for the purpose, and it usually doesn't take four months.

 

Adopt a motion ordering the President to turn over the records. If the President refuses, see FAQ #20 and consider consulting a lawyer.
