Kev Berry Posted March 30, 2014 at 12:02 AM Report Share Posted March 30, 2014 at 12:02 AM We have heard of a takeover bid of the committee and officials at our next AGM. We believe this will not be in the clubs best interests and believe the takeover is purely to asset strip the club The person applying for chairmans position resigned from that position at last years AGM, after being elected as chair at that meeting because things in the AGM did not go his way, he took thank you gifts and honorary membership .He is aware that half the committee do not want him back, he has had his cohorts apply to stand for these positions and to try and get the standing committee members ousted by those he intends bringing to the AGM, which rarely has more than 10% of its members attend. Is there anything we can do to stop this hostile takeover, voting of official positions is by show of hands only at AGM
jstackpo Posted March 30, 2014 at 12:09 AM Report Share Posted March 30, 2014 at 12:09 AM Basically, as in any political situation, rally the troops to get the "good guys" to show up at the meeting and elect someone more to your liking at the meeting. Majority rules.

If members feel these people are only out for personal gain, then they should elect someone else.
Thomas Ralph Posted March 30, 2014 at 08:47 AM Report Share Posted March 30, 2014 at 08:47 AM And if you think that people are scared of not being seen to vote for this guy, move that the vote be taken by ballot.
Kev Berry Posted March 30, 2014 at 07:59 PM Author Report Share Posted March 30, 2014 at 07:59 PM problem is our AGM's are usually poorly attended, people say they will come but wont, there is a large contingency backing these guys probably only 30 or so out of a club of 600, our Agm's tend to attract only around 50 members. So apart from getting enough there to keep them out that's it then?Is there anything we can do after the voting if they fail to get what they want ie chuck them out of the club? According to you, there are 30 on their side, maybe 20 on yours, and the rest don't care. Good luck with that.
Josh Martin Posted March 30, 2014 at 08:27 PM Report Share Posted March 30, 2014 at 08:27 PM So apart from getting enough there to keep them out that's it then? Yes. Is there anything we can do after the voting if they fail to get what they want ie chuck them out of the club? Well, you can check your bylaws (or Ch. XX of RONR if your bylaws are silent) for disciplinary procedures, but I don't know how you're going to pull that off unless you can get more people to show up. jstackpo Posted March 30, 2014 at 08:40 PM Report Share Posted March 30, 2014 at 08:40 PM If things go really bad (from your point of view), you could (I suppose) get your friends together and start a new association. See pp. 553 for "how-to" instructions. If the sports club has any assets, you most likely do not get to take them with you.
