My real question is if you only vote for 1 out of the required 3 is that vote illegal or is it counted? I understand if you vote for 4 and you are only required to vote for 3 that ballot is illegal? You seem to be under the impression, however, that an illegal ballot is not counted. This is not correct. An illegal ballot is not credited toward any particular candidate, but it is counted toward the total number of ballots cast. Link to comment Share on other sites More sharing options...

Those ballots are legal, and count as one ballot cast, as well as one vote for each of the candidates that are selected. The same would be true if a voter, say, wrote in the name of a person not eligible to hold office, along with two correct votes. The one vote would not be valid, but the other two would. A ballot with votes for four names when only three seats are up for election is an illegal ballot. It still counts as one ballot cast, but it is not possible to tell which candidates should be credited, so none of them are. A ballot that is left completely blank, or otherwise expresses no preference for anyone, is not counted as a ballot cast. It does not affect the results of the election.
