Guest Stephen Posted April 3, 2014 at 04:16 AM Report Share Posted April 3, 2014 at 04:16 AM The annual budget was passed at the agm the president insists the money does not have to be spent as presented at the agm he can spend all the money on staffing if he sees fit.?The by law readsThe board of trustees must submit a budget for the coming yearThe trustees may not expend more than the total budget, but shall not be obligated to the allocation of funds as provided therein however if the board agree unanimously that a Bona Fidel emergency exists they may make additional expenditures as they dem necessary to meet such emergency. All such emergency expenses must be ratified at the next agm
jstackpo Posted April 3, 2014 at 09:45 AM Report Share Posted April 3, 2014 at 09:45 AM The president appears to be interpreting the bylaws in a manner that Guest_Stephen disagrees with. RONR suggests how to resolve such differences on p. 588ff. We here are not in a position to interpret them for the association - only the association, collectively, can do that. Gary Novosielski Posted April 3, 2014 at 04:37 PM Report Share Posted April 3, 2014 at 04:37 PM Well, we can't give you a ruling on what your bylaws mean. But I would point out that your question refers to the president doing whatever he likes, while the bylaws you quoted referred to the trustees (or presumably a majority thereof) doing whatever they liked. __________And I think Bona Fidel was replaced by Bona Raul.
