Late Voting

If the ballots are being counted then yes I would agree that there is no one voting at that point.  However, I think the difference is that if the assembly adopted a motion to close the polls that means that they are ordering that no one else can vote even if there are those who still wish to do so.  If a motion to close the polls was adopted the late arriving member could not vote (and I'm not sure it would even be in order to move to reopen them).  On the other hand, if the ballots had started to be counted because there appeared to be no one who still wished to vote and then a member came in and wanted to vote I think page 408 would apply.

Regardless of the method by which the polls were closed, the chair should declare the polls closed before the ballots are counted.  If a member enters the room after that declaration, he may vote only if a motion to reopen the polls is adopted.  The procedure is described in RONR (11th ed.), p. 415, ll. 11-23.

 

To answer Ms. Griffith, if the ballots are being counted, we can assume that the polls are closed.  The member who arrives during the counting of the ballots may not vote unless a motion to reopen the polls is adopted.
