Membership types and voting

We are a non-profit association made of of local and state regulators. we have 6 types of memberships. Our by-laws state that our active membership "includes, but is not limited to the following privileges and benefits: voting...". The other levels benefits are not mentioned, but only discuss who qualifies for those types of memberships. 

We have an agency membership that would be a state department (Natural Resources, Public Health). Our by-laws do not specify if this membership votes or not. Should it be given one vote, more, or none?

So far as RONR is concerned, all members have one vote.

 

If your organization has six types of membership with different privileges, however, your bylaws may well provide otherwise. See RONR, 11th ed., pgs. 588-591 for some Principles of Interpretation.

When do you have a second vote if the majority vote is very close?

 

If a voice vote is inconclusive, the chair should order a rising vote (or even a counted rising vote, if necessary) on his own initiative to ensure that the result is accurate. If he fails to do so, a single member may demand a rising vote by calling for a Division of the Assembly, or the assembly may order a counted rising vote by majority vote.

Per RONR, the concept of membership includes certain rights, among them the right to vote.  Many threads on this topic in this forum cause me to believe it takes a bylaw-level rule to restrict the right to vote, either by limitation or elimination of it.  If your bylaws do not specify either way, particularly not restricting or eliminating the right, I'm inclined to say the NRPH agency has the right to vote.  As noted, one member one vote is the RONR way.  A check of your bylaws, however, as well as the pages noted in Post #2, is warranted as you have 5 more types of membership than is the expected.

I concur, and it would also require a rule at least on the level of the bylaws to grant a member more than one vote.
