JBR Posted April 28, 2014 at 08:49 PM Report Share Posted April 28, 2014 at 08:49 PM Presiding officer wants to conduct nominations from the floor at our final meeting of the year wherein we elect our officers. Our by-laws state that nominations from the floor were to be done at the meeting prior to the final (last) meeting. This was not done then. Can nominations from the floor still be done? Guest Edgar Posted April 28, 2014 at 09:03 PM Report Share Posted April 28, 2014 at 09:03 PM And members can cast a "write-in" vote for anyone who wasn't nominated. Irregularities in the nominating process are usually not fatal.
Rev Ed Posted April 29, 2014 at 03:34 PM Report Share Posted April 29, 2014 at 03:34 PM Irregularities in the nominating process are usually not fatal. As long as people can be nominated, and members can make nominations, this issue is not fatal. Plus, it may be beneficial to make the By-law a bit more clear, for example the By-law could state that nominations are to be opened at the prior meeting and shall remain open until a motion to close nominations at the following meeting. It wouldn't be "fatal" (which I assume means that the election would be invalid) even if no one could be nominated and no one could make nominations. As Edgar notes, members can cast write-in votes for members who are not nominated. Failing to take nominations at all would not constitute a continuing breach.
