Guest Janb Posted May 16, 2014 at 02:46 PM Report Share Posted May 16, 2014 at 02:46 PM At our Board of Gov's meeting in March 2014 - we had the election of our officers and our Executive committee members. Later that month, one of our Phases had their board meeting and voted off the Board member that had been elected to the 2014 Executive committee. However, the President of the Country Club has ruled to keep this particular person on the Executive committee even though they no longer sit on their Phases' Board nor on the Board of Gov's. Can the President of the Country Club make this decision?
Rev Ed Posted May 16, 2014 at 02:49 PM Report Share Posted May 16, 2014 at 02:49 PM The President can only do this if the By-laws of the organization allow him/her to do so.
Guest Janb Posted May 16, 2014 at 04:02 PM Report Share Posted May 16, 2014 at 04:02 PM Is it normal for the By-laws to be written this way?
Gary Novosielski Posted May 16, 2014 at 04:09 PM Report Share Posted May 16, 2014 at 04:09 PM It's hard to say. There is a wide range of "normal". For that matter, the board can't vote off a member of the board unless the bylaws are written to allow it. Unfortunately (or perhaps fortunately) we don't do bylaws interpretation here. We can tell you that if the bylaws are silent, discipline procedures are contained in Chapter XX (20) of RONR.
