Guest Jeff Harding Posted May 20, 2014 at 06:59 PM Report Share Posted May 20, 2014 at 06:59 PM We have twenty two members voting in a general election, our bylaws say " Winners in any final election will be determined by count to see who has recieved greater than 50% of the vote from the total voting members present plus counted absentee ballots." Two Questions 20 voting members 2 absentee 22 votes total the first Ballot is 11 for A and 10 for B with one ballot not being cast? If the ballot that was not cast was an abstain do you still count it?If the ballot was just not filled out does it count? I have bolded the part that is in question. If 22 members vote and 11 go for A and 10 Go for B with one abstain what is the greater than 50% number needed.
Dan Honemann Posted May 20, 2014 at 07:28 PM Report Share Posted May 20, 2014 at 07:28 PM The phrase "greater than 50% of the vote from the total voting members present plus counted absentee ballots" is found nowhere in RONR, and is obviously ambiguous (otherwise, I'm sure you wouldn't be asking this question). I'm afraid you're on your own.

Gary Novosielski Posted May 21, 2014 at 03:29 PM Report Share Posted May 21, 2014 at 03:29 PM RONR advises against ever counting absentee ballots along with ballots of present members. In reading your bylaws snippet, I can't make any more sense out of it than you can, and we don't do bylaws interpretation here. That's up to your membership to do.
