Guest Guest Posted June 25, 2014 at 08:52 PM Report Share Posted June 25, 2014 at 08:52 PM 1) Can members be disciplined if there is not a policy for disciplinary procedures incorporated in the by-laws? 2) A vote was taken on a disciplinary issue to censure a member for misconduct (although this procedure does not exist in the by-laws) at the end of the vote it was deemed to not have passed, but a week later it is now being questioned on the tally of the vote being counted incorrectly although it was not caught on the day of the meeting by anyone nor was this session recorded. Is there any merit for the questioning of the vote at this time ? Should it be allowed? If so are there suggestions on how it should be handled ? If you've adopted RONR as your parliamentary authority you've adopted its disciplinary procedures (Chapter XX). 2. Unless there's proof that that ineligible votes (e.g. votes by non-members) could have affected the outcome, it's too late to object to the outcome as stated by the chair. And I think you're certainly better off having the motion to censure improperly defeated than if it had been improperly adopted. You could always make the motion again.
