Guest Southern Inquirer Posted July 12, 2014 at 10:01 AM Report Share Posted July 12, 2014 at 10:01 AM We may have just found out that our Parliamentarian who is posted in our Associations Annual Meeting is still a paid Office Staff "employee" of said Association. Is that not a conflict of interest and how to do we rebuttal when we bring up a "Request of Information" to the Chair to ask if this is so? jstackpo Posted July 12, 2014 at 11:08 AM Report Share Posted July 12, 2014 at 11:08 AM Conflict of interest isn't actually defined in RONR. Closest thing is a moral restriction on voting, p. 407 which probably doesn't apply. There are various restrictions on a "member parliamentarian" - see p. 467. So you will have to look to your rules and bylaws to see if there really is a problem with the situation you describe. A "Request for Information" is properly used when a particular motion is pending, not for fishing expeditions.
Timothy Posted July 12, 2014 at 11:18 AM Report Share Posted July 12, 2014 at 11:18 AM I find it highly unlikely that this is a conflict of interest since the job of the parliamentarian is to advise the chair on parliamentary procedure. There isn't much (anything?) that a parliamentarian can do that would give special treatment to his position on staff.
Guest Southern Inquirer Posted July 12, 2014 at 11:24 AM Report Share Posted July 12, 2014 at 11:24 AM Thank you....in the past it has been advised by the BOD that the Parliamentarian not be one of the paid staff members who are directly supervised by the President of the organization since the Pres. is their direct supervisor. The membership has not been notified that the Parliamentarian is also a paid staff member and we would like to notify the membership at our annual convention and would like to know how this information can be presented and how in the past the BOD has not allowed such appointment to occur
Timothy Posted July 12, 2014 at 12:05 PM Report Share Posted July 12, 2014 at 12:05 PM Unless your bylaws say otherwise, what the BOD says about it is nothing more than an opinion. If the BOD wishes it to be more than that, they can make a recommendation during their report. If some member wants to make an issue of it, they can make a motion. But as for what the BOD thought in the past, that is in the past. The current BOD may not have the same opinion.

The role of the parliamentarian is to advise the president on parliamentary procedure--which the president is free to follow, reject, or ignore completely. It certainly would be problematic if the parliamentarian was the supervisor of the president.
