Executive Session

If you're referring to the minutes of meetings that were held in executive session then, yes, any current member of the body that was meeting has a right to see those minutes.

 

In other words, access is not restricted to only those persons who were members at the time the meeting was held.

If there have been executive sessions prior to the incoming or a new organizational president, will those executive session be available to the new president?

 

The President would be allowed to see those Minutes, as would any other member for which the Minutes belong to (i.e. If the President is a member of the Board, then he/she would be entitled to see Minutes of Board meetings.)

 

If this was not allowed, then newer Board members may not know what the decisions the Board has made previously and may end up debating issues that have already been dealt with.

Or even worse, adopting a motion that was in conflict with something previously adopted, and if the previous motion was some kind of financial arrangement this could spell some real trouble.
