members voting rights for election of officers

Our class election is happening in December 2014. We have members that have not paid dues this year. Can they still cast their votes for officers and vote in election? They did pay dues last year.

This is what our bylaws state:To become and active and voting member each person must pay $5.00 per meeting or $120 per year to receive active members status. This is all it states about voting members. Also some members has just paid $5.00 the whole year, can they vote?

Well, RONR p. 406 says " A member of a society who is in arrears in payment of his dues, but who has not been formally dropped from the membership rolls and is not under a disciplinary suspension, retains the full rights of a voting member and is legally entitled to vote except as the bylaws may otherwise provide."  Whether your bylaws disenfranchises members in arrears is for you all to determine.

If this is truly all your bylaws say on the subject, then it would appear that all of these members are able to vote.

 

Many societies adopt a provision in their bylaws which provides for members to be suspended of their rights or dropped from membership if they have failed to pay their dues for a certain period of time, but in the absence of such a provision, members in arrears of their dues retain all the rights of membership.
