Guest Len Haring Posted October 8, 2014 at 03:29 PM Report Share Posted October 8, 2014 at 03:29 PM Our non-profit organization has set in the bylaws to 1) appoint an elections comittee in October, 2) Take floor nominations and the report of the elections committee in November and voting in December. We have an issue where we can appoint the comittee as required, but our meeting place has just been closed until Jan 2015.Can the membership motion to move the floor nominations/report and voting until Jan 2015 due to the emergency? Edgar Guest Posted October 8, 2014 at 03:41 PM Report Share Posted October 8, 2014 at 03:41 PM A few members can meet in front of the closed venue and adjourn (continue) the meeting to a more convenient place (and, perhaps, date). This is one of the very few actions that can be taken without a quorum. Obviously you'd then need to inform the members of the new location (and date). This way you'll be able to obey your bylaws. Kim Goldsworthy Posted October 8, 2014 at 04:00 PM Report Share Posted October 8, 2014 at 04:00 PM (schedule)... OCT = election committee appointed... NOV = floor nominations... DEC = voting Can the membership motion to move the floor nominations/report and voting until Jan 2015 [...]?Good news."Yes." The motion, "To re-open nominations" (or in your case, perhaps it should be worded "to open nominations"?) can be moved at any time an election is pending.Even if you have the rule embedded in your bylaws.Perhaps you will have to move "to suspend the rules" first, because there is such a rule embedded in your bylaws. But the bottom line is, it is easy enough to allow late nominations. I am sure your organization will inform your membership that there has been a change in venue, or a change in date, whatever the case may be.As you give such a notice, you should re-announce the fact that elections will be conducted. That bit of information should satisfy whatever notice would have been necessary.
