SJSchmidt Posted October 12, 2014 at 08:48 PM Report Share Posted October 12, 2014 at 08:48 PM If a Nominating Committee member is nominated, is that person removed from the committee and its further discussion? Our bylaws do no address this.
Gary Novosielski Posted October 12, 2014 at 09:58 PM Report Share Posted October 12, 2014 at 09:58 PM No, it's fine for the nominating committee to nominate nominating committee members. Nobody gets removed from anything.

Richard Brown Posted October 12, 2014 at 10:00 PM Report Share Posted October 12, 2014 at 10:00 PM Is your question, "if a member of the nominating committee is nominated for one of the positions to be filled at the election, does he remain a member of the nominating committee or is he automatically removed when his name is placed in nomination?" If that's the question, then the answer is that he remains a member of the nominating committee regardless of the fact that he is one of the nominees for office in the upcoming election. However, once the nominating committee has made its nominations and reported them to the assembly, it's job is finished and it ceases to exist. "A nominating committee is automatically discharged when its report is formally presented to the assembly". RONR page 435. So, in that sense of the word, he is no longer a member since the committee no longer exists.

But he's not one of the nominees until the nominating committee has presented its report. And at that point, you say, he can no longer be a member of the nominating committee since the committee has ceased to exist.
Richard Brown Posted October 12, 2014 at 10:30 PM Report Share Posted October 12, 2014 at 10:30 PM But he's not one of the nominees until the nominating committee has presented its report. And at that point, you say, he can no longer be a member of the nominating committee since the committee has ceased to exist.Well, he might well be the member of the nominating committee who knows before the release of the final report that he will be the nominee for Grand Potentate. As to continuing to be a member of the committee after it ceases to exist, I'm not aware of how that could be accomplished, short of the committee being revived later due to the withdrawal of a nominee. Please enlighten us.

I think we're on the same page here. Perhaps I should have said, "And at that point, as you rightly say, he can no longer be a member of the nominating committee since the committee has ceased to exist". But I'm still not convinced that his knowledge of the committee's yet-to-be-made report makes him a nominee.
