And the president's position is vacant. The vice is acting chair and the question arose, "can he make a motion and have a vote"? because he is "acting" president but technically still the Vice President? FAQ #1 has some useful info related to your question. Also, do your bylaws not say how to fill in the vacancy of the president? The default rule in RONR is that the vice president automatically becomes the president when there is a vacancy in that position (i.e. there is no "acting" and the vacancy is now in the position of vice president). If it's due to an incomplete election, then hold an election. Otherwise, the Vice President is now the President, not not acting in anyway.
