RandyW Posted January 12, 2015 at 05:37 PM Report Share Posted January 12, 2015 at 05:37 PM My name is Randy and I am new here. My question is about a board or committee responding to a letter of appeal.According to our by-laws a member has ten (10) days to appeal a decision (in writing), made by the board to terminate said member. Is there any rule stating how much time the appeal committee has to respond with a date for a hearing. I would appreciate if someone could Please point me in the direction to look in the RONR to research this on my own as well. Thank you in advance. Richard Brown Posted January 12, 2015 at 06:32 PM Report Share Posted January 12, 2015 at 06:32 PM Is there any rule stating how much time the appeal committee has to respond with a date for a hearing. NoWell, I agree with my friend George that RONR does not set a precise time frame, but it is understood that hearings, meetings, etc must be held with "reasonable" advance notice. What is reasonable in any particular situation depends on the circumstances and must be determined by the organization.... or the courts if the matter winds up there. Is one day's notice sufficient notice for all necessary parties to adjust their schedules and be prepared for a hearing? Personally, I think not, but that's a judgment call that your organization (or the committee) must make. As to pointing you in the right direction for more information, RONR devotes 56 pages in Chapter XX to disciplinary matters. However, if your organization has customized disciplinary procedures, then many (or perhaps none) of the disciplinary procedures in RONR will apply. It still provides valuable guidance on the steps in a fair disciplinary process, though. I strongly suggest you get a copy of the newest edition (the 11th edition) of RONR and study that chapter. Do not go by an older version. That chapter was revised significantly in the 11th edition. http://www.robertsrules.com/book.html
RandyW Posted January 12, 2015 at 06:52 PM Author Report Share Posted January 12, 2015 at 06:52 PM Thank you both for responding. I have stated that the member had only 10 days, and it has been almost 20 days since the member has complied but has not heard anything in the way of a response. Thanks again I will search that chapter.

Well, the discipline procedures in Chapter XX. of RONR are quite different from the ones apparently in place in your society, so you won't find the answers to questions about your specialized rules in RONR. In RONR, the board has no right to remove members at all, much less terminate them..

In RONR, the board has no right to remove members at all, much less terminate them..Then all is relied on the by-laws of our social club and its practicing standards, makes perfect sense. Our by-laws state certain infractions that are punishable by ,suspension, fine , or termination due to the severity or reoccurence of said charges.
