Hello,

We have a situation where a current vice president is now running for president, with other candidates.  The vice president's term is not offcially up as the office terms are staggard.  With him openly running for president now does the nominating committee need to open up the vice president's position for election too?  Another words, does this man who now is running for president need to resign his vice president position to be on a planned written ballot?  We intend to have one ballot with ALL candidates for all positions to conduct voting all at one time.

The vice-president's office shouldn't be on the ballot since there's no vacancy (and might not be one). If the vice-president is elected president and then resigns the office of vice-president (which RONR doesn't actually require but which is probably a good idea), then you'll have a mid-term vacancy in the the office of vice-president. If your bylaws don't provide for filling mid-term vacancies (e.g. appointment by the president or by the board), you'll need to hold a special election.

 

In any event, there's no need to resign one office before being nominated for, and elected to, another office.

First :  The V-P does NOT have to offer his resignation to run for some other office, although if he/she gets elected president, he should resign (maybe your bylaws already say "one office per person" [RONR does not] which would take care of that).

 

Second:  What should the NomCom do? Well...  that depends on what your bylaws say as to how to fill a (non-presidential) vacancy.  Can't be a bad idea for the NomCom to be looking around for a POSSIBLE  --  make that clear to any of those possibilities  --  replacement for the V-P, should he win.  But the bylaws would have the final say as to how the vacant V-P position would be filled. Also if it looks like the V-P's campaign is going nowhere, the NomCom might be justified in doing nothing.

 

You also might want to consider breaking out the elections for each office into separate elections, if that made things more straightforward.
