eligibility for office

According to an organizations bylaws, an officer MUST be a member in order to be elected and serve as an officer.

If the officer does not join the association in the year that they will be serving in the office, and will not resign their office, how does the membership proceed to remove this officer.they are clearly in violation of their bylaws

At the next membership meeting, raise a point of order that the officer does not meet the eligibility requirements in the bylaws. The election of an ineligible person is null and void.

 

It is not clear that the officer was ineligible when elected. I read Guest Jan's post to mean that the officer failed to renew his or her membership after being elected. If so, the election was not null and void, but the office became vacant when the officer's membership lapsed. In either event, I agree that a point of order should be raised. (This assumes, of course, that the bylaws indeed require officers to be members, and that the officer indeed is no longer a member. But note that mere non-payment of dues, if that is what happened, does no result in automatic loss of membership, unless the bylaws say so.)
