Breach of Previously Approved Motion

Recommended Posts

Guest

This may not be a question that can be answered in this forum, but here goes.

At a County Commission meeting a motion was made and approved to pay a company money if they would move into the county and agree to hire XX number of employees within a few years. Time passes and a new County Commission is in place. Is there any obligation for the new Commission to honor the previously approved agreement with out a contract ?

As far as RONR is concerned, a passed but not executed motion stays in effect until executed or rescinded, irrespective of how many members of the body that passed the motion are still members now.

There are potential legal aspects to this which the county commission should refer to its lawyers.

For future reference you'll find this forum works best when you open a new thread to post a new question, even if it may seem to pertain to an older topic.
