Guest Jan W Posted November 21, 2018 at 02:13 AM Report Share Posted November 21, 2018 at 02:13 AM Our HOA sent out an "official" announcement of annual mtg. with note that 2 board positions are open due to 2 expiring terms. Then a 2nd letter was sent called a "reminder" letter about annual mtg where election was to take place. The "reminder" letter explained that the 2 individuals whose terms were up are willing to serve anther term and "any homeowner who wishes to run for a board position should send bio to mgmt. company". Follow-up--Mgmt Co. has no intention of sending these bios of homeowners wishing to run to all homeowners in association before election. Vote is by attendance at meeting or proxy only. For those not attending (whether or not they send in proxy) is this not punitive on members not attending as they have no way of knowing that other homeowners wish to run for Board positions? Rationale is that "reminder" letter was just that. "Official" letter only stated 2 positions were up for election-no mention that 2 existing board members agreed to run again. Only "official" letter is important one! Help!!!

Guest Zev Posted November 21, 2018 at 08:15 PM Report Share Posted November 21, 2018 at 08:15 PM Isn't it the case that HOAs in many states have legal statutes restricting them from doing certain things, and in some cases requiring them to do others? Is it possible that this is one of those cases?
Guest Who's Coming to Dinner Posted November 21, 2018 at 09:44 PM Report Share Posted November 21, 2018 at 09:44 PM 19 hours ago, Guest Jan W said: For those not attending (whether or not they send in proxy) is this not punitive on members not attending as they have no way of knowing that other homeowners wish to run for Board positions? That's what they get for not showing up. There is no rule in RONR that members must be advised of nominations in advance.
