Guest Sharon Posted April 21, 2019 at 08:52 PM Report Share Posted April 21, 2019 at 08:52 PM I was at an Architectural Review Committee Board meeting for a Home Owners Association. The ARC committee denied an application for landscaping changes pending more information. At the Board meeting, the members of the Board voted to approve the request (at the end of the meeting after it was adjourned). Is this legal? PRIOR to adjournment, while the meeting is still in progress, quite possibly. We would need to know more about just what your rules say. But after the meeting has adjourned, especially if any members have departed, it is improper and null and void pursuant to RONR. Can you tell us a bit more about how this business after adjournment happened?
jstackpo Posted April 21, 2019 at 10:26 PM Report Share Posted April 21, 2019 at 10:26 PM Also tell us if the ARC, per the bylaws (or the "covenant", or whatever the document is called that establishes the HOA), has full authority to act on such matters, or is merely an advisory group to the Board. Quote the bylaws, please; no paraphrases.
