Guest SJK Posted June 25, 2019 at 02:25 AM Report Share Posted June 25, 2019 at 02:25 AM A Board Member abstained from voting on a major landscape contract due to working within local industry. Subsequent meeting he initiated Motions involving landscape items and votes, is this allowed or should he been told to abstain? All projects awarded to same contractor. While RONR notes that a member "should" abstain for voting on a matter in which he has a "direct personal or pecuniary interest not in common to other members," it also notes that the member cannon be compelled to abstain (p. 107, ll. 21-31). It is not clear that the the contract would be "direct personal or pecuniary interest." These other matters probably would not rise to that level. Even if they did, he could vote on them. If the rules in RONR apply, the fact that a member abstained on awarding a contract does not affect the member's right to vote on future items related to that same contract. No one can be ordered to abstain.
